N.S. injury cap: submission from Richard Halpern

Many people and organizations have made submissions to the Superintendent of Insurance as part of the Nova Scotia government’s Minor Injury Cap Review process.

Ontario lawyer Richard Halpern has made his submission. Halpern states that he has been very involved in auto insurance reform in Ontario for several years, having interaction with the provincial government and CEO of the FSCO. Halpern serves as a member of the Reform Implementation Steering Committee to advise on the implementation of recently announced reforms.

In his submission, Halpern says that there was no reasonable justification for the limit imposed by the Nova Scotia cap when it was introduced in November 2003. His opinion and submission to the Superintendent of Insurance is that “it is in the interests of access to justice and consumer rights that the cap can be revoked retroactively.”
